Welcome to Pealth. These Terms of Service ("Terms") govern your access to and use of the Pealth mobile application and related services (collectively, the "Service") provided by Pealth ("we," "our," or "us").

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Description of Service

Pealth is an AI-powered nutrition tracking application that allows users to:

  • Track food intake through photo recognition and manual logging
  • Monitor nutritional information including calories and macronutrients
  • Track intermittent fasting schedules
  • Access AI-powered nutrition insights and recommendations
  • View health metrics and progress dashboards

2. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use our Service. If you are under 18, you must have parental or guardian consent.

3. Subscription and Payments

Free and Premium Services

Pealth offers both free and premium subscription tiers. The free tier provides basic nutrition tracking features, while premium subscriptions unlock additional features such as unlimited AI food recognition, advanced insights, and personalized recommendations.

Billing

  • Premium subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selection).
  • All payments are processed through the App Store (Apple) or Google Play Store (Android).
  • Subscription fees are non-refundable except as required by applicable law or as stated in the applicable app store's refund policy.

Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until then.

Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated in advance and will apply to your next billing cycle after notice.

4. User Conduct

When using our Service, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload malicious content, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any unlawful or fraudulent purpose
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems or bots to access the Service
  • Collect or harvest user data without authorization
  • Impersonate any person or entity

5. Intellectual Property

The Service, including its content, features, and functionality, is owned by Pealth and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without written consent
  • Create derivative works based on our Service

User Content

You retain ownership of content you submit to the Service (such as food photos). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze your content solely for the purpose of providing and improving the Service.

6. Health Disclaimer

IMPORTANT: Pealth is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The nutritional information and AI-generated insights provided by Pealth are for informational purposes only.
  • Our AI assistant provides general nutrition information, not medical advice.
  • Nutritional estimates from food photo recognition may not be 100% accurate.
  • Always consult with qualified healthcare professionals before making significant changes to your diet, starting a fasting regimen, or making health-related decisions.
  • If you have a medical condition, eating disorder, or are pregnant or nursing, consult your healthcare provider before using our Service.
  • Do not disregard professional medical advice or delay seeking treatment based on information from our Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pealth and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and associated data
  • Provisions that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or through the app settings.

10. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pealth is incorporated, without regard to conflict of law principles.

Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you through the app or email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Pealth regarding the Service.
  • Severability: If any provision is found invalid, the remaining provisions will remain in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
